1.总则

1.1用户应当同意本协议的全部条款并按照页面上的提示完成全部的注册程序。用户在进行注册程序过程中点击"注册"按钮即表示用户与润桐专利检索网站网站达成以下协议，完全接受本协议项下的全部条款，本协议即在用户与润桐专利检索网站之间产生法律效力，对双方均具有法律约束力。
1.2用户注册成功后，将获得自行注册的用户账号和自行设定的密码在润桐专利检索网站的使用权限，该用户帐号和密码由用户负责保管；用户应当对以其用户帐号进行的所有活动和事件负法律责任。
1.3润桐专利检索网站有权对协议进行不定期修订、更新。修改后的协议一经公布即有效替代原有协议，新协议公布时会以适当方式通知用户，用户可随时查询最新协议。
1.4如果您不同意本协议的相关条款，请您立即停止使用本网站及其服务。
1.5您同意使用本网站及其技术服务时，您应保证具备签订合同的民事行为能力。

2. 用户注册

2.1当您在本网站或使用本网站服务时，您应当提供完整、准确、真实的注册信息。如果您没有提供完整、准确、真实的注册信息，因此而导致您的权利受损，本网站免责。
2.2请您妥善保管您的密码和帐号。非因本网站原因导致的密码及帐号泄露，本网站不承担法律后果。
2.3当您的账户、用户名及密码非经您本人授权被使用时，您应及时通知本网站。本网站及时采取措施，减少您的利益受损。但在本网站采取措施之前的损失，本网站免责。
2.4对于您从本网站了解的商业秘密，您有义务保密。未经本网站的书面许可，您不得向任何第三方披露或允许其使用该商业秘密。

3.用户信息保护

3.1 您在注册帐号时和使用本网站服务时本网站将采集包括注册信息、订阅信息等用户信息。
3.2 润桐专利检索网站对收集的用户信息中涉及识别用户个人身份和用户个人隐私的信息进行保护，不会将用户的上述信息对外公开或提供给任何第三方，但以下情况除外：

4. 用户行为规范

4.1您不得将我们的服务标志、注册商标、文档及图片、计算机软件等从其原来的位置上移除或做任何修改；
4.2您不得实施侵犯本网站内容及计算机软件所涉及的知识产权之行为；
4.3不得注册恶意的用户账号或利用本网站账号，进行违法活动，以及干扰、欺骗、损坏本网站其他网站，以及网站用户。
4.4不得在本网站内容或您上传的资料中安装插件或软件，以上传、链接、跳转、推广非本网站授权的资料。
4.5不得利用本网站上传违反法律、行政法规、互联网管理方面的部门规章之内容，包括但不限于：宣传暴力、色情、破坏民族团结、侮辱、诽谤他人之内容。
4.6不得利用本网站或对本网站进行传播病毒、进行黑客攻击、入侵计算机系统、窃取他人的帐号及密码、侵犯他人商业秘密及其他知识产权之行为。
4.7对于前述4.1到4.6条等违反国家法律、行政法规的行为，本网站有权在不通知您的情况下删除非法信息，并有权对您的帐号进行关闭或注销，不再提供知识产权服务， 且不退还您已经支付的所有费用；由此造成的一切损失，由您自行负责， 本网站免责。

5. 润桐专利检索网站服务规则及内容

5.1用户需自行配备使用电话咨询和上网所需的设备。 5.2润桐专利检索网站的用户同意接受本平台通过电子邮件、短信平台、即时通信的客户端、网页或其他合法方式向用户发送知识产权服务内容或其他相关服务信息。 5.3用户依本协议所取得的服务权利不可转让。 5.4用户应遵守国家法律、行政法规、或服务协议，如用户违法行为损害他人合法权益，导致本平台遭受任何损害或遭受任何来自第三方的索赔要求等，用户应向本平台赔偿相应的损失，用户并需对其违反服务条款所产生的一切后果负全部法律 责任。

6. 免责声明

6.1防止黑客攻击和计算机病毒入侵一直是我们努力的目标，我们将采取措施，包括使用当下的防护措施，来保护用户的注册信息和帐号之安全，以及本网站的安全。但我们不能担保您的帐户和密码以及本网站一定免受攻击。因此而导致的不能正常使用，我们将免责。
6.2非本网站所控制的通信线路故障导致您不能使用本网站而造成的损失，不承担赔偿责任。
6.3因本网站的技术故障等不可预测事件影响到服务的正常运行的，本网站承诺在第一时间与相关单位配合，及时处理进行修复；但是，您因此而遭受的一切损失，本网站免责。
6.4您在向本网站输入文件时，应事先做好备份，因信息丢失使您遭受损失的，本网站免责。
6.5因政府或司法行为导致您的不能使用本网站，我们将免责。
6.6本网站的雇员没有违反对您的法定义务情况下，造成您的损失，本网站免责。

7. 知识产权声明

7.1本网站及其技术的唯一所有者和使用者为江苏润桐数据服务有限公司。
7.2本网站上的内容和计算机技术软件的物权及知识产权归属江苏润桐数据服务有限公司，用户不得侵犯知识产权。

8. 通知和公告

8.1、 润桐专利检索网站向向用户发送的所有通告，将通过页面公告、手机短信息、客户端信息推送或电子邮件的方式传送。润桐专利检索网站活动信息也将定期或不定期通过上述方式向用户发送。用户协议条款的修改、服务变更、或其它重要事件的通告都会以此形式 进行。
8.2、 用户可以选择接受或不接受润桐专利检索网站向通过上述形式向其发送订阅信息等信息。用户选择不接受的，可以随时通知取消发送。

9.法律管辖和适用

9.1、 本协议的订立、执行和解释及争议的解决均应适用中华人民共和国大陆地区法律。
9.2、 如发生本协议条款与上述法律相抵触时，则这些条款将完全按上述法律规定重新解释，但不影响其它合法条款对用户产生的法律效力和影响。
9.3、 本协议的规定是可分割的，如本协议任何规定被裁定为无效或不可执行，则该规定可被删除，不影响其余条款的继续执行。
9.4、 如双方就本协议内容或其执行发生任何争议，双方应尽力友好协商解决；协商不成时，任何一方均可向上海市徐汇区人民法院及其上一级人民法院提起诉讼。

General Use and Restrictions

    You must follow any applicable laws and regulations, including export and re-export control laws and regulations, any policies made available to you on the Platform, as well as, if any, the agreements between you and Runtong with respect to or in connection with any particular services provided by Runtong. You understand and agree to not misuse the Platform. For example, You may not (a) make the service or any Materials (defined below) on the Platform available to anyone other than a user authorized by Runtong; (b) sell, resell, rent or lease any portion of the service; (c) interfere with or disrupt the integrity or performance of the service or third-party content provided in the service; (d) attempt to gain unauthorized access to the service or its related systems or networks; (e) reverse engineer any portion of the service; (f) access the service in order to build a competitive product or service; (g) access the service using “bots” or “spiders” or any automated system that calls to a service more frequently than may reasonably be performed by a human user using a standard web browser; or (h) not interfere with the Rainpat or try to access it using a method other than the interface and the instructions that Runtong provides. You must use commercially reasonable efforts to prevent any unauthorized access to or use of any service or Materials on the Platform and promptly notify Runtong of any such unauthorized access or use. Runtong may suspend or stop providing the Platform and its services to you if you do not comply with Runtong’s terms or policies or if Runtong is investigating suspected misconduct.
    You agree not to reproduce, duplicate, copy, download, store, further transmit, disseminate, transfer, or otherwise exploit Rainpat, or any portion hereof, without Runtong’s prior written consent. No logo, graphic, sound or image from Rainpat may be copied or retransmitted unless expressly permitted by Runtong. Also, you may not “mirror” or replicate any Materials contained on the Platform on any other server without Runtong’s prior express written permission.
    As part of your use of the Platform and Runtong’s services, you may receive access to additional data, content, software or applications subject to separate terms. Rainpat may display certain content that did not originate from Runtong. This content is the sole responsibility of the entity that makes it available. We reserve the right to suspend or terminate content originated from these entities at any time.
    These Terms of Service will supersede and control over any conflicting or additional terms and conditions of any provisions of an agreement you may have with Runtong and other previously issued Terms of Service. These Terms of Service control the relationship between you and Runtong. They do not create any third party beneficiary rights. A failure by Runtong to exercise, or any delay in exercising, any right or remedy provided under these terms or by law shall not constitute a waiver of that or any other right or remedy. If any provision of these Terms of Service is held to be invalid or unenforceable, the provision will be enforced to the maximum extent permissible so as to effect the intent of the parties, and the remaining provisions of these terms will remain in force.

Fees and Payment

    Your subscription to Runtong’s services will continue on a recurring monthly or annually basis corresponding to the term of your subscription unless and until you cancel your subscription or your account is otherwise suspended or discontinued pursuant to these Terms of Service. If you subscribe to any service or purchase any Materials, you must provide accurate billing and payment information and keep this information up-to-date. By accessing Rainpat and Runtong’s services, you are expressly agreeing that (i) we are authorized to charge you a periodic subscription fee on a recurring basis corresponding to the term of your subscription, any other fees for additional services you may purchase, and any applicable taxes in connection with your use of your subscription; (ii) we may submit charges incurred under your account for payment; and (iii) you will be responsible for such charges.

Cancellation and Refund

    You can cancel your subscription at any time, and you will continue to have access to Runtong’s services through the end of your subscription period. You must cancel your subscription before your next renewal date in order to avoid the next billing. Due to the type of information being licensed and the service provided to you, we are unable to accept or offer returns once the subscription is activated, services is performed or Materials are purchased. To the extent permitted by the applicable law, all payments are non-refundable and we do not provide refunds or credits for any partial subscription periods.

Changes to Pricing

    We may change our service plans and the price of our services and/or data from time to time. We will notify you of any price changes and these changes will only occur on your next billing cycle.

Intellectual Property

    All materials provided on Rainpat and by Runtong, including but not limited to data, information, documents, products, logos, graphics, sounds, images, software, and services (“Materials”) are provided either by Runtong or by third party authors, developers and vendors (“Third Party Providers”) and are protected by intellectual property laws. The trademarks, service marks, trade names, logos and copyrights appearing on the Platform are trademarks and copyrights of Runtong, its affiliates, and/or licensors.

Privacy Policy

    Please review our Privacy Policy to understand how we can make your user experience better by using certain personal information we collect on the Platform or when you use our services. By using Rainpat and selecting to opt-in and agree to our Privacy Policy, you agree that Runtong can use your information in accordance with our Privacy Policy.

Warranties and Disclaimers

    Runtong and ITS SUPPLIERS OR DISTRIBUTORS do not MAKE ANY SPECIFIC PROMISES ABOUT THE PLATFORM OR Runtong’S SERVICES AND MATERIALS. FOR EXAMPLE, Runtong DOES NOT MAKE ANY COMMITMENTS ABOUT THE CONTENT ON THE PLATFORM, THE SPECIFIC FUNCTIONS OF THE PLATFORM, OR THEIR RELIABILITY, AVAILABILITY, OR ABILITY TO MEET YOUR NEEDS. PATECTCLOUD PROVIDES THE SERVICES AND MATERIALS ON THE PLATFORM “AS IS” AND HEREBY DISCLAIMS ALL EXPRESS OR IMPLIED REPRESENTATIONS, WARRANTIES, GUARANTIES, AND CONDITIONS, INCLUDING FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT.

Limitations of Liability

    Runtong SHALL NOT BE LIABLE FOR ANY LOST PROFITS, REVENUES, OR DATA, FINANCIAL LOSSES OR INDIRECT, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES SUFFERED AS A RESULT OF USING, MODIFYING, CONTRIBUTING, COPYING, DISTRUBTING, OR DOWNLOADING THE MATERIALS, HOWEVER IT ARISES, WHETHER IN AN ACTION OF CONTRACT, NEGLIGENCE OR OTHER TORTIOUS ACTION, ARISING OUT OF OR IN CONNECTION WITH THE USE OR PERFORMANCE OF INFORMATION AVAILABLE FROM Rainpat OR Runtong’S SERVICES, EVEN IF Runtong HAS BEEN PREVIOUSLY ADVISED OF THE POSSIBILITY OF SUCH DAMAGE.
    TO THE EXTENT PERMITTED BY LAW, THE TOTAL LIABILITY OF Runtong, AND ITS SUPPLIERS AND DISTRIBUTORS, FOR ANY CLAIMS IN CONNECTION OF YOUR USE OF THE SERVICE, INCLUDING ANY IMPLIED WARRANTIES, IS LIMITED TO THE AMOUNT YOU PAID Runtong TO USE THE SERVICES WITHIN TWELVE (12) MONTHS PRIOR TO SUCH CLAIM. Runtong MAY CHOOSE TO EXTEND YOUR SERVICE PERIOD AS A REMEDY. IN ALL CASES, Runtong, AND ITS SUPPLIERS AND DISTRIBUTORS, WILL NOT BE LIABLE FOR ANY LOSS OR DAMAGE THAT IS NOT REASONABLY FORESEEABLE.
    UNDER NO CIRCUMSTANCES SHALL Runtong BE LIABLE FOR ANY LOSS OR FAILURE TO PERFORM ITS OBLIGATIONS DUE TO FORCE MAJEURE, INCLUDING BUT NOT LIMITED TO LABOR SHORTAGES, STRIKES, RIOTS, ACTS OF GOD, FLOODS, LIGHTNING, FIRE, EPIDEMIC, POWER OR COMMUNICATION UTILITY INCLUDING INTERNET SHORTAGES, FAILURES, EARTHQUAKES, WAR, OR RESTRICTIONS, REGULATIONS, ORDERS IMPOSED BY ANY GOVERNMENT, AGENCY OR SUBDIVISION THEREOF.

Indemnification

    You agree to indemnify, defend and hold harmless Runtong, its parents, subsidiaries, and affiliates, and their respective officers, directors, employees and agents, from and against any and all claims, actions, liabilities, damages, losses, costs, expenses and fees (including attorneys’ fees) arising from or related to your use of Rainpat or violation of these Terms. If you are using Rainpat or Runtong’s services and Materials on behalf of a business, that business accepts these Terms of Service.

Modifying and Interpreting the Terms of Service

    Runtong may from time to time modify these terms or any additional terms that apply to Runtong’s service and Materials. Runtong may add or remove any functionalities or features, and may suspend or stop a service altogether. You may elect to stop Runtong’s services or Runtong may stop providing services and Materials to you at any time. Runtong will post notices or notify you of modifications and additional terms. Changes will not apply retroactively and will become effective no sooner than fourteen (14) days after they are posted. However, changes addressing new functions for Runtong’s service and/or Materials or changes made for legal purposes take effect immediately. If you do not agree to the modified terms for Runtong’s service and/or Materials, you may elect not to opt-in and agree with our Terms of Service or discontinue your use.

Governing Law and Jurisdiction

    Any disputes arising out of or relating to this Terms of Service or Runtong’s services (“Dispute”) are governed by the laws of Jiangsu. You hereby consent to the exclusive jurisdiction of Hong Kong, in the event that you bring any legal action against Runtong with respect to any Dispute. Your submission to the jurisdiction of Jiangsu shall not prejudice Runtong’s right to commence action against you in any court of competent jurisdiction.
